MSCHE Statement on USDE “Guidance for Ensuring Complaint Procedures for Accrediting Agencies are Timely, Fair, and Equitable”

The United States Department of Education (USDE) issued “Guidance for Ensuring Complaint Procedures for Accrediting Agencies are Timely, Fair, and Equitable” on August 7, 2023. The Middle States Commission on Higher Education (MSCHE) is proud of its work relating to complaints and third-party comments and, therefore, reminds all constituents that no other organization represents our Commission’s position regarding this important policy topic.

“Recent statements made by the Council for Higher Education Accreditation (CHEA) expressing concerns about this Guidance for accreditors simply does not represent the position of our Commission,” said President Heather F. Perfetti. “Our work makes it clear that we value responsiveness to students who express concerns relating to institutional quality, and the fact that we took a proactive position in our policy and procedures is direct evidence of that.”

The Commission centers students in its work, and this is reflected in revised policy and procedures, effective July 1, 2023, relating to complaints.  The changes adopted by the Commission were undertaken without the requirement of regulatory pressure or Guidance from the Department.  This was done in response to our constituents, including students, as well as through an open call for public comment.  The changes reflect the Commission’s commitment to the highest quality of service to students, institutions, and the public.

The USDE Guidance articulates nine factors in determining whether agencies’ procedures are timely, fair, and equitable as required by 34 CFR § 602.23(c)(1). The Commission has evaluated its revised policy and procedures since the release of the Guidance and is confident that our approach is meaningful for constituents and meets the expectations of the Guidance.  A newly launched complaints web page and form streamline the submission process and provide accommodations for students who may not have access to an online submission form.
